These Terms and Conditions of Service ("Terms") govern your access to and use of the IndoFinity platform, services, and features. By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms in full.
1. Definitions and Scope
1.1 Definitions
- "Services" includes the IndoFinity platform, web applications, interactive features, and all related content
- "User" is any individual or entity that accesses or uses the Services
- "Content" includes text, images, video, audio, and other materials uploaded or created through the platform
- "Premium Features" are paid services with additional functionality
1.2 Scope of Services
IndoFinity provides a technology platform to enhance the live broadcast experience with:
- Interactive overlay tools for streaming platforms
- Integration systems with social media platforms
- Basic analytics of live broadcast activity
- Attendee aggregation tools for interactive activities
2. Eligibility and Acceptance of Terms
2.1 User Requirements
To use the Services, you must:
- Be at least 18 years of age or have parental/legal guardian consent
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the Services under applicable law
2.2 Acceptance of Terms
By using the Services, you expressly agree:
- To be bound by all terms in this document
- To comply with all applicable laws and regulations
- To be fully responsible for the use of your account
3. Platform Services and Features
3.1 Free Service Access
All platform features are accessible for free with certain limitations:
- Full access to all features: interactive overlays, participant collection tools, donation integration, and basic analytics
- Item creation limits: each feature has a maximum limit on items that can be created or used
- Example limitations: a maximum of 5 sound effects, 7 interactive tool settings, or 1 configuration preset
- Community support: access to documentation and community forums
3.2 Premium Package (Limit Unlocker)
The premium package removes usage restrictions:
- Creation limit removal: unlimited access to create items in all features
- No limit on the number of: overlays, templates, settings, and Unlimited configurations can be created
- Priority support: technical assistance with faster response
- Feature beta access: early access to new features under development
3.3 Service Modifications
We reserve the right to:
- Update, modify, or discontinue certain features
- Add new services with or without prior notice
- Perform scheduled maintenance that may impact service availability
4. User Obligations and Responsibilities
4.1 Authorized Use
Users are required to:
- Use the Services for their intended purposes
- Comply with all applicable laws and regulations in their respective jurisdictions
- Respect the intellectual property rights of third parties
- Maintain the security and confidentiality of account credentials
4.2 Prohibited Use
Users are strictly prohibited from:
- Using the Services for illegal, fraudulent, or harmful purposes
- Disrupting or damaging the integrity of the platform's systems and infrastructure
- Disseminating unlawful, misleading, or harmful content
- Performing unauthorized reverse engineering, decompilation, or system analysis Written Terms
4.3 External Platform Compliance
Users are responsible for complying with the terms of service of external platforms (TikTok, YouTube, etc.) when using our integration features.
5. Intellectual Property Rights
5.1 Platform Ownership
All intellectual property rights in the IndoFinity platform, including but not limited to:
- Source code, algorithms, and system architecture
- User interface design and user experience
- Trademarks, logos, and visual identity
- Technical documentation and marketing materials
Are the exclusive property of IndoFinity and are protected by applicable intellectual property laws.
5.2 User Content
- Users retain full ownership of the content they upload.
- By uploading content, Users grant IndoFinity a limited, non-exclusive license to display that content within the platform's operational context.
- IndoFinity does not claim ownership of User Content.
6. Payment System and Financial Transactions
6.1 Payment Model
- Freemium Model: All features are available for free with certain item creation limitations.
- Subscription System: Recurring payments to remove usage limitations.
- Currency: All transactions are in Indonesian Rupiah (IDR) unless otherwise stated.
- Payment Processing: Handled by a licensed and certified third-party payment gateway
6.2 Pricing Policy
- Prices are subject to change at any time with 30 days' notice
- Additional taxes and fees may apply in accordance with local regulations
- Promotions and discounts may have specific terms and conditions
6.3 Transaction Security
- IndoFinity does not store or process credit card information or sensitive payment data
- All financial transactions are encrypted and processed through PCI DSS-compliant infrastructure
7. Refund and Cancellation Policy
7.1 Premium Subscription
- Subscription model: Recurring payments for unlimited access
- Subscription cancellation: Can be done at any time with premium access continuing until the end of the billing period
- Automatic downgrade: Once the subscription ends, the account reverts to the free limit
- No refunds: Subscription payments that have been processed are non-refundable
7.2 Refunds Based on Special Circumstances
Refunds may be considered under certain circumstances as follows:
- Documented technical failure in the provision of premium services during the subscription period
- Account cancellation by IndoFinity without any breach by the User
- Significant service changes that materially affect subscription functionality
7.3 Refund Procedure
- Requests must be submitted within 7 business days of the incident
- Supporting documentation and evidence must be provided
- Approved refunds will be processed via the original payment method
- Refund decisions are final and cannot be contested
8. Privacy and Data Protection
User personal data is collected, processed, and protected in accordance with our Privacy Policy, which is an integral part of these Terms. IndoFinity is committed to complying with international data protection standards and Indonesian personal data protection regulations.
9. Suspension and Termination of Services
9.1 Temporary Suspension
IndoFinity may suspend User access in the following situations:
- Suspected violation of the Terms requiring investigation
- Suspicious activity that could compromise platform security
- Requests from authorized legal authorities
9.2 Permanent Termination
Account termination may occur due to:
- Material violation of these Terms
- Proven and documented illegal activity
- Repeated abuse after a formal warning
- Failure to pay for premium services already used
9.3 Consequences of Termination
Upon account termination:
- Access to all services will be permanently terminated
- Premium subscriptions will be canceled without refund
- Account data may be deleted in accordance with the data retention policy
10. Limitation of Liability and Indemnification
10.1 Limitation of Liability
IndoFinity provides services "as is" and makes no express or implied warranties regarding:
- Uninterrupted service availability
- Fitness for a particular purpose
- Accuracy or completeness of information
10.2 Limitation of Indemnity
In the event of any loss, IndoFinity's liability is limited to:
- A maximum amount equal to the premium subscription fee for the last month
- Excluding indirect losses, lost profits, or consequential losses
10.3 Indemnification by the User
The User agrees to indemnify and hold IndoFinity harmless from any claims, losses, or costs arising from:
- Violation of the Terms by the User
- Unlawful use of the service
- Violation of third party rights by the User
11. Applicable Law and Dispute Resolution
11.1 Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia, in particular:
- The Electronic Information and Transactions Law (UU ITE)
- Applicable consumer protection regulations
- Contract law and obligations Indonesia
11.2 Dispute Resolution
Disputes will be resolved through:
- Direct negotiation between the parties within 30 days
- Mediation through a mutually agreed mediation institution
- Arbitration in accordance with the rules of the Indonesian National Arbitration Board (BANI)
- A competent court in Yogyakarta, Indonesia as a last resort
12. General Provisions
12.1 Severability
If any provision of this document is declared invalid or unenforceable, the remaining provisions will remain in full force and effect.
12.2 Changes to Terms
- Material changes will be notified 30 days prior to their effective date
- Non-material changes may be made without prior notice
- Use of the service after the change is deemed acceptance
12.3 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement.
